1. GENERAL PROVISIONS
The General Terms and Conditions of the online stores www.andrazgregoric.com and www.portretnafotografija.com are prepared in accordance with the provisions of:
- the Consumer Protection Act (ZVPot-1);
- the Personal Data Protection Act (ZVOP-1);
- the Electronic Commerce Market Act (ZEPT).
These General Terms and Conditions apply to all relationships and legal transactions between the service or goods purchaser and the company, unless the company and the customer conclude a separate written agreement.
The General Terms and Conditions apply to customers who are consumers in accordance with applicable regulations.
The General Terms and Conditions form an integral part of the sales contract between the company and the customer.

3. INTELLECTUAL PROPERTY
All published photographs (unless stated otherwise) and all content of the websites www.andrazgregoric.com and www.portretnafotografija.com are the copyrighted work of Fotografske storitve, inž. fot. Andraž Gregorič, s.p., and are protected by copyright law. The company reserves all copyright rights. Commercial use without the company’s permission is prohibited.
The customer may use photographs solely for personal purposes. Any other use is permitted only with the written consent of the author or if expressly agreed in a contract between Andraž Gregorič s.p. and the customer.
4. CONCLUSION OF A DISTANCE CONTRACT
A distance contract between the company and the customer is concluded when the company sends the customer an order confirmation, invoice, and gift voucher after the customer submits an order for a gift voucher via the dedicated online form available on the company’s website.
The order confirmation is sent to the email address provided by the customer when submitting the order. The order is stored electronically on the company’s server.
5. TECHNICAL STEPS FOR CONCLUDING A DISTANCE CONTRACT
The online store allows orders without registration.
The company offers two contract methods depending on whether immediate payment is made at checkout or payment is made via bank transfer (TRR).
IMMEDIATE PAYMENT AT CHECKOUT:

Go to the service page you wish to purchase as a gift voucher and select:
- “BUY GIFT VOUCHER”
- REVIEW AND PAYMENT
A new window for entering details will open.
- To change quantity, click “Quantity” and then “+” or “–”.
- Enter contact details.
- Select a payment method and enter payment details.
- Review the information and correct it if necessary.
By placing the order, you agree to payment and confirm that you understand and accept our Terms and Conditions and Privacy Policy.
- To complete the purchase, click “PAY”.
- ORDER SUMMARY AND INVOICE
Your purchase is completed.
Once payment is confirmed, you will receive a confirmation email and a digital invoice within 24 hours. If you do not receive it, please check your spam folder or contact us.
PAYMENT VIA BANK TRANSFER (TRR)
- SELECTION
Select the gift voucher for the service you wish to order.
- ORDER
Enter the following in the contact form:
- details of the gift voucher you are ordering,
- contact details (and delivery address for physical gift vouchers).
- Review and correct the information if necessary.
- Click “SEND”.
- PAYMENT
Within 24 hours, we will send you an invoice by email.
By paying the invoice, you agree to our Terms and Conditions and Privacy Policy.
- ORDER SUMMARY AND INVOICE
The purchase is completed upon payment of the invoice.
After payment confirmation, you will receive a confirmation email within 24 hours.
6. PRICES AND PAYMENT METHODS
PRICES
All prices are stated in EUR. VAT is not charged pursuant to Article 94(1) of the VAT Act (ZDDV). Prices do not include delivery costs. Prices are valid at the time of order submission and under the payment methods and business conditions set by the company.
PAYMENT METHODS
The company accepts the following payment methods:
- Credit card (Visa or Mastercard). Payments are processed via the secure Stripe payment system.
- Bank transfer to the account of Andraž Gregorič s.p. using a UPN/SEPA form.
Only one payment method may be used per order. Orders cannot be processed until payment is confirmed. Once payment is confirmed, the customer will receive an order confirmation email and invoice.
7. ORDER CHANGES
Customers are advised to review and correct entered data before submitting an order. After submission, order changes are not possible.
8. ORDER CONFIRMATION
After successfully submitting an order, the customer receives an email confirmation including order confirmation and invoice. If the email is not received, the customer should check the spam folder or contact info@andrazgregoric.com
9. SHIPPING COSTS AND DELIVERY
PERSONAL COLLECTION
Personal collection is possible by prior arrangement with the company. Customers wishing to collect an order in person should notify the company as soon as possible after placing the order, by phone or email.

SHIPPING COSTS
Shipping cost for a gift voucher is EUR 5.
DELIVERY TIME
Order preparation and delivery time is 2–5 business days. The company does not dispatch goods on Saturdays, Sundays, or public holidays.
10. ISSUANCE OF INVOICE
The invoice is sent to the email address provided by the customer. The invoice includes all costs related to the purchase. The customer must verify invoice accuracy and report any errors within eight days of receipt. Complaints submitted after this period will not be considered.
Until the invoice is paid, the company is not obliged to deliver photographs.
11. WITHDRAWAL FROM THE CONTRACT FOR ONLINE PURCHASE OF A GIFT VOUCHER
RIGHT AND DEADLINE FOR WITHDRAWAL
The customer has the right to withdraw from the contract within 14 days without stating a reason. The withdrawal period begins on the day following receipt of the gift voucher. This right does not apply to legal entities.
REFUND
Within 14 days of receiving the withdrawal notice, the company will refund the purchase amount, including delivery costs. Refunds will be made using the same payment method used by the customer unless otherwise requested. The company may withhold the refund until the returned gift voucher is received.
12. GIFT VOUCHER
The gift voucher of www.andrazgregoric.com and www.portretnafotografija.com is a value instrument issued upon payment. It may be issued in physical or electronic form (with a unique serial number).
The company undertakes to accept the gift voucher as payment for services offered in the online store. Gift voucher credit cannot be used to purchase another gift voucher.
VALIDITY
The gift voucher is valid for one year from the date of issue.
Validity may be extended within six months after expiration for a fee of EUR 20. After this period, extension is no longer possible.
REDEMPTION
The gift voucher must be redeemed in full. If the purchase value exceeds the voucher amount, the difference must be paid by the voucher holder.
Gift vouchers cannot be exchanged for cash and do not accrue interest.
LIMITATION OF LIABILITY
The company is not responsible for loss, theft, unauthorized use, or damage to gift vouchers. In such cases, the voucher balance will not be refunded.
13. EYE PHOTOGRAPHY
By booking and attending an eye photography session, the customer confirms that they have read, understood, and accepted the Terms and Conditions and Privacy Policy of Andraž Gregorič s.p.
The company assumes no liability for possible eye injuries or other damage that may occur during eye photography. The customer accepts this risk.
14. APPOINTMENT RESERVATION
Services are provided by prior agreement regarding location, date, and time of service or voucher redemption. Customers should contact the company by email or phone to book an appointment.
15. PROCESSING, STORAGE, AND USE OF PHOTOGRAPHS
The company undertakes to perform its services professionally. The agreed number of photographs will be post-processed and delivered to the customer electronically. Unedited or RAW photographs are not provided.
Unless the customer requests deletion, the company reserves the right to store photographs indefinitely but is not obliged to archive them for more than seven days after delivery.
With the customer’s consent, photographs may be used for the company’s promotional purposes in all media.
16. ONLINE STORE SECURITY
The company uses appropriate technology to protect the transmission and storage of personal data and payments. The online store, among other measures, uses an SSL certificate issued by an authorized organization.
To ensure that credit card authorizations and transactions are secure, the company and its payment service provider Stripe use security tools and practices to maintain a high level of safety.
Credit card authorizations are performed in real time, with immediate verification of data with banks using 3DS2 authentication. Card data is not stored on the supplier’s server.
17. PRIVACY POLICY
PROTECTION OF PERSONAL DATA
We respect your personal data and collect it only to the minimum extent necessary. On the websites www.andrazgregoric.com and www.portretnafotografija.com we enable the purchase of gift vouchers without registration and therefore do not collect unnecessary personal data.
Andraž Gregorič s.p. undertakes to carefully safeguard and protect your personal data in accordance with the Personal Data Protection Act (ZVOP-1) and the General Data Protection Regulation (EU) 2016/679 (GDPR) (hereinafter also: the GDPR Regulation).
a) COLLECTION, USE AND PROCESSING OF PERSONAL DATA
We collect your personal data from you via the websites www.andrazgregoric.com and www.portretnafotografija.com (by browsing the website, placing an order, communicating with you, etc.) and from other sources (Google, Facebook, etc.).
We will collect, use and process your personal data only for internal purposes of Andraž Gregorič s.p. and for the operation of the online stores www.andrazgregoric.com and www.portretnafotografija.com : without your consent (for the purpose of contract performance, our legitimate interest, or fulfilling legal obligations) and/or with your consent, which you may withdraw at any time.
For the operation of the online stores www.andrazgregoric.com and www.portretnafotografija.com , we collect the following personal data of users:
- first and last name,
- address,
- email,
- phone number,
- data you enter into forms on our website when placing an order.
The data you enter into the contact form will be used to respond to your enquiry. By clicking the “Send” button, you agree to this. Upon your request, we can provide you with a document showing all data you entered via the contact form on our website and submitted to us.
We store the personal data you provide to us until you withdraw your consent. Upon your request, we can delete all personal data we store about you.
For security purposes (to prevent credit card misuse and attacks on the information system), we collect:
- IP address data,
- device location data from which you access our website.
Each user is assigned a session cookie for identification and monitoring of the shopping cart. We may also store other cookies on the device you use to access the website. More information about cookies can be found in the “Cookies” section.
b) SHARING PERSONAL DATA WITH BUSINESS PARTNERS
We share your personal data with our business partners who store and use this data for the operation of the online stores www.andrazgregoric.com and www.portretnafotografija.com and for security purposes. Our business partners include:
- payment services: Stripe, 354 Oyster Point Boulevard, South San Francisco, CA 94080, USA,
- delivery: Pošta Slovenije d.o.o., Slomškov trg 10, 2500 Maribor, Slovenia.
c) DISCLOSURE OF PERSONAL DATA
Personal data collected, stored and processed by Andraž Gregorič s.p. will be disclosed only where required by law, or where such action is necessary for proceedings before courts or other public authorities, or for the protection and enforcement of the legitimate interests of Andraž Gregorič s.p.
d) USER RIGHTS
You can read about your rights regarding the processing of personal data in the European GDPR Regulation.
You have, among other rights, the right to:
be informed which data we collect about you, for what purposes, the expected retention period, where we obtain your personal data, to whom we disclose it, and what other rights you have in relation to the processing of your personal data;
rectification and completion of personal data if we hold inaccurate data about you;
deletion of your personal data. Certain personal data may be retained for up to 10 years after the last document relating to your order, as we are obliged to retain it to comply with legal obligations or for the establishment, exercise or defense of legal claims;
restriction of processing, enabling your data to be excluded from processing for a certain period of time;
data portability, meaning you may receive all personal data you provided to us which we process based on your consent and for contract performance;
objection to processing (for direct marketing purposes);
lodging a complaint if you believe that our processing of personal data violates the European GDPR Regulation or national personal data protection legislation.
PROTECTION OF BIOMETRIC INFORMATION
During eye photography, biometric information is collected. The company uses eye photographs exclusively for the provision of the service and for producing the final product for the customer.
The company undertakes to protect the customer’s biometric information and not to misuse it. The company assumes no responsibility for misuse of such information by third parties.
The company shares biometric information and photographs exclusively with business partners who use such data for the operation of Andraž Gregorič s.p. and for producing the final product (photo canvas) for the customer.
COOKIES
Cookies are files that are downloaded to your device’s browser when you visit our website. They enable our websites www.andrazgregoric.com and www.portretnafotografija.com to function, improve speed and security, store settings during your visit, allow sharing on social networks, and provide other information when you revisit the website or switch between tabs. The cookies we use do not contain data that could directly identify you.
Session cookies are deleted from your device when you end the session and close your browser, while persistent cookies remain stored on your device and are deleted after the expiry period of each cookie.
Statistical and advertising cookies are optional and require your consent. If you consent, we may share information with advertising and social networks about how you use our website. This data is anonymous or based on unique identification of the device and browser. We do not provide these partners with your identifying personal data. Such processors include:

PRIVACY SETTINGS
When you visit our online store, a cookie notice is displayed:
- strictly necessary cookies (for proper operation and usability),

- advertising cookies.
After setting cookie preferences, you can close the cookie notice by clicking “x”.
If you click the button “Accept recommended settings”, statistical cookies will be enabled.
If you close the window without choosing cookie settings, all optional cookies will be disabled.
After the cookie expiry period, cookies will be deleted.

Slovenian law applies to the interpretation of these terms. The competent court for resolving disputes is the court in Slovenia. For all rights and obligations not governed by these General Terms and Conditions, the provisions of the Code of Obligations, the Consumer Protection Act, and other legislation of the Republic of Slovenia shall apply.
